They will always propose a dead person because they cannot have a living Satoshi else their protocol changes and their divergence from the Whitepaper is at risk of exposure. If Satoshi is dead, they have carte blanche to speak on his behalf - as was witnessed in the COPA trial when they spoke about what Satoshi would know, would have done, what records he would have kept, etc to counter any answer CSW gave.
