I think at the moment the judge would be taking a risk to say CSW is Satoshi. The judge will not want to find out later on that he made a mistake. The judge can easily say, "the evidence I see before me is that Craig Wright has submitted back dated documents in order to show he is Satoshi. Because of this I will rule he is not Satoshi. If the judge later is found to be wrong he at least has a reasonable excuse. He can just say…"on the evidence I saw I just could not judge Craig Wright was Satoshi." It's the safest route for the judge.
