Isn’t that the one reason that BTC is functionally broken? Small block prevents growing transaction rate and fees organically by increasing the size. BSV has seen blocks with fees over 1 coin, right?
Wouldn’t that end up being a blow to BTC and BCH value? If a legal claim was ignored, then some interesting things could be triggered depending on jurisdiction.
My comment about honesty was more targeted at the individual or group that would have the authority to give the direction to the miners to execute the court order. I don’t see any way that a single key holder could be granted that type of authority.
True. Disputes between entities are resolved in court though. If not CSW, I think it would have landed in court eventually. I think it healthy to discuss and determine how this type of situation would be handled.

Of course the entities would need to be trusted/honest/independent to prevent the improper manufacture of coins. The bar could be higher than the 51% generally used as honest node req.
Instead of a single key like the alert, there would be several entities holding keys. To be valid, an agreed number of entities would need to sign the order. This would provide some level of resistance to a stolen/compromised key.
Thinking a multisig transaction that would freeze UTXO and reissue equivalent value to the plaintiff who won the case/arbitration.
I think the code to effect the return would be similar. I see the biggest challenge is how to get the recovery order to the miners in a way that can’t be abused. Something akin to the alert that was removed. Probably needs to require multiple signatures.
