In the US, patents are enforceable on a First To Invent basis. So he would have to prove he was the first to invent something (some of his patents would likely be considered as invented by satoshi)

In many (most?) other places (EU etc) he only needs to be first to file, which is likely why he said this.

His patent trolling will likely continue forever
