Because earlier I had the insightful thought that Craig couldn't be charged with a crime of theft if they claimed he moved freshly-bought coins recently sent to Genesis address from an exchange, while at same time easily showing he controlled that address in Genesis as (likely) only Satoshi would. 
Quite the simple thoughtful strategy.
